Jimotravel Terms of Service

BESPLA Inc. (hereinafter referred to as the "Company") hereby establishes the following terms and conditions (hereinafter referred to as the "Terms") for the use of the crowd-avoidance tourism app "Jimotravel" (hereinafter referred to as the "App") and the services provided through the App (hereinafter referred to as the "Service").
Users of this Service (including domestic and international travelers; hereinafter referred to as "Users") are requested to read these Terms carefully and use this Service upon agreement with these Terms.

Chapter 1: General Provisions

Article 1 (Purpose)

  1. These Terms are intended to establish the terms of use of the Service and to define the rights and obligations between the Company and Users.
  2. This Service aims to provide tourism information, visibility of congestion status, and suggestions for avoiding congestion, with the purpose of suppressing overtourism, avoiding congestion, and promoting regional dispersal tourism (such as guiding users to less crowded times and locations).
  3. Users shall use this Service in accordance with these Terms and the rules presented by the Company within the App or on the Company's website, upon agreement with these Terms.

Article 2 (Definitions)

Unless otherwise specified, the following terms used in these Terms shall have the meanings set forth below:

  • Service: All services provided by the Company through the App (including features to be added in the future)
  • User: Any person who uses this Service (regardless of whether they have completed user registration)
  • Registration Information: Information provided by Users to the Company during registration or in connection with the use of this Service (e.g., email address, nickname, date of birth, gender, interests/preferences, settings, etc.)
  • Location Information: Information regarding the User's current location obtained through GPS or similar functions on the User's device, including real-time and historical data
  • Statistical Information: Information that has been anonymized, aggregated, and processed so that individuals cannot be identified (e.g., aggregated values of stay patterns by time zone in specific areas, congestion trends, etc.)
  • Partner Municipalities: Municipal governments (cities, wards, towns, villages, prefectures, etc.) that support the purpose of this Service (congestion suppression, dispersal tourism, etc.) and cooperate with the Company for information distribution and policy consideration
  • Partner Businesses: Businesses that provide coupons, points, incentives, stamp rallies, tourism information, product/service information, etc. through this Service (including stores, facility operators, transportation providers, etc.)

Chapter 2: Service Content

Article 3 (Service Overview)

  1. This Service mainly provides the following features (names and content are examples and may be changed or added in the future):
    1. Provision of tourism information (spots, events, local specialties, regional cuisine, etc.)
    2. Visualization of congestion status and suggestions for congestion avoidance (time zones, routes, alternative spots, etc.)
    3. Map functions (spot display, current location display, routes, surrounding information, etc.)
    4. Coupons, points, incentives, etc. (conditions for granting and use may be set)
    5. Notification distribution (notifications from partner municipalities and partner businesses, important announcements, etc.)
    6. Travel log recording and sharing features (posts including photos/videos, sharing, comments, etc.)
    7. Display of reference information on disasters and congestion status (*not official information; see Article 18)
    8. Other ancillary services provided by the Company
  2. Use of this Service requires an internet connection. Data charges shall be borne by Users.
  3. Some features of this Service may require permission for device location settings, notification settings, camera functions, etc. If permission is not granted, such features may not be available.

Article 4 (Position of Congestion Forecasts and Avoidance Suggestions)

  1. Congestion forecasts, congestion status displays, avoidance suggestions, route suggestions, estimated travel times, etc. (collectively referred to as "Congestion Forecasts") in this Service are reference information for Users' decision-making.
  2. The Company does not guarantee the accuracy, completeness, timeliness, usefulness, fitness for a particular purpose, or safety and comfort for Users (e.g., definitely uncrowded / definitely fast / definitely safe) regarding Congestion Forecasts.
  3. Users understand that actual conditions may change due to weather, traffic regulations, accidents, construction, disasters, events, facility operating conditions, etc., and shall make final decisions at their own responsibility.

Chapter 3: Terms of Use

Article 5 (Eligibility)

  1. This Service is available to persons aged 18 years or older.
  2. This Service is intended for use not only within Japan but also by travelers from overseas (including but not limited to English-speaking countries, Taiwan, China, and Korea). Users shall comply with the laws and regulations of the country or region where they are staying or residing (including telecommunications regulations, import/export regulations, content regulations, etc.) when using this Service.
  3. If a User violates this Article and causes damage to the Company or third parties through the use of this Service, the User may be liable to compensate for such damage.

Article 6 (User Registration and Account Management)

  1. This Service has features that can be used by completing user registration through methods specified by the Company (e.g., external ID integration, email verification, etc.). The Company may also provide features that can be used without registration.
  2. Users shall provide true and accurate information in their registration information and promptly update such information through methods specified by the Company if any changes occur.
  3. Users shall manage their devices, accounts, authentication information, authentication codes, etc. appropriately at their own responsibility and shall not allow third parties to use them (basic measures for preventing impersonation).
  4. The Company may treat all actions performed under a User's account as actions of that User.
  5. If there is a risk of unauthorized use by third parties due to loss or theft of the device, Users shall promptly notify the Company following the procedures specified by the Company (in-app guidance, inquiry desk, etc.).
  6. The Company may take measures such as restricting simultaneous use of the same account, additional authentication when changing devices, or forced logout for security purposes.

Chapter 4: Information Collected and Purpose of Use

Article 7 (Information Collected)

The Company collects the following information about Users to the extent necessary for providing this Service (whether information is collected varies depending on User settings, device permissions, and usage conditions):

  • Location Information (real-time and historical): Current location, travel routes, stay patterns, etc. (can be changed through device settings)
  • Behavioral Data: Browsing, search, and click history within this Service; records of visited spots (travel logs, etc.); information related to check-ins and QR code usage, etc.
  • Device Information: Device type, OS/app version, device identifiers, language settings, notification settings, IP address, etc.
  • Survey/Input Information: Nickname, date of birth, gender, interests/preferences, profile images; inquiry content, feedback, etc.
  • Posted Content (travel logs, etc.): Text, images, videos, comments, stamps, etc. posted by Users (may include personal information of third parties)

*This Article provides an overview; details are specified in the Privacy Policy.

Article 8 (Purpose of Use)

The Company uses the collected information primarily for the following purposes in accordance with the Personal Information Protection Act and other applicable laws:

  • Analysis of congestion status, generation of congestion forecasts, provision of congestion avoidance suggestions
  • Provision of this Service, identity verification/authentication, account management, inquiry response
  • Optimization of tourism information, improvement of displayed content, enhanced convenience (display of recommended information, etc.)
  • Service quality maintenance and improvement, troubleshooting, prevention of unauthorized use, security measures
  • Consideration of tourism policies and regional dispersal measures by partner municipalities, effectiveness measurement (*conducted after processing into statistical information; see Article 10)
  • Statistical analysis, research and development, marketing analysis (conducted in a non-personally identifiable manner)
  • Provision and operation of coupons, points, incentives, stamp rallies, etc. (including future offerings)

Article 9 (Relationship with Privacy Policy)

  1. The handling of personal information by the Company (including details of collected items, retention periods, third-party provision, methods for disclosure requests, etc.) shall be in accordance with the Privacy Policy separately established by the Company.
  2. In the event of any inconsistency between these Terms and the Privacy Policy, the Privacy Policy shall prevail with respect to the handling of personal information.

Chapter 5: Third-Party Provision and Statistical Use

Article 10 (Information Provision to Municipalities)

  1. The Company may provide information to partner municipalities to the extent that it serves the purpose of this Service (suppression of overtourism, congestion avoidance, promotion of regional dispersal tourism).
  2. Information provided to partner municipalities is limited to statistical information that cannot identify individuals. The Company anonymizes, aggregates, and processes location information, behavioral data, etc. into a form that cannot identify individuals before providing it.
  3. The Company requires partner municipalities not to re-identify (estimate or identify who an individual is) from the provided statistical information and not to allow third parties to re-identify.
  4. The Company does not provide personal information (personal data) of Users to partner municipalities except as required by law.

Article 11 (Outsourcing and External Services)

  1. The Company may outsource all or part of its operations to third parties to the extent necessary for providing this Service (e.g., cloud services, data analysis platforms, distribution platforms, map functions, reverse geocoding, etc.).
  2. The Company shall exercise necessary and appropriate supervision to ensure that appropriate safety management measures are taken by contractors in accordance with the Personal Information Protection Act and other applicable laws when selecting contractors.
  3. When Users use external services (e.g., map services), the external service providers may independently collect and use information. In such cases, the terms and privacy policies of those external service providers shall apply.

Chapter 6: Prohibited Activities

Article 12 (Prohibited Activities)

Users shall not engage in the following activities when using this Service:

  • Activities that violate laws, public order and morals, or these Terms
  • Unauthorized access, impersonation, or unauthorized use of accounts
  • Unauthorized acquisition, scraping, crawling, reverse engineering, modification, or analysis of data or content from this Service
  • Using this Service for purposes not intended by the Company, such as sales, resale, or improper customer acquisition
  • Activities that cause inconvenience or disadvantage to partner municipalities, partner businesses, tourist destinations, local residents, or other Users (e.g., encouraging nuisance behavior, intentionally causing congestion, defamation, etc.)
  • Activities that infringe or may infringe the rights of third parties (copyrights, portrait rights, privacy, etc.) in posts such as travel logs
  • Registering or posting false information
  • Activities that interfere or may interfere with the operation of this Service
  • Activities that infringe the rights or interests of the Company or third parties
  • Other activities deemed inappropriate by the Company

Chapter 7: Intellectual Property Rights

Article 13 (Ownership of Rights)

  1. All intellectual property rights, including copyrights and trademark rights, related to this Service and the App belong to the Company or the rightful owners.
  2. Users shall not reproduce, reprint, distribute, publicly transmit, modify, etc. the content of this Service without the explicit permission of the Company.

Article 14 (User Posts)

  1. The rights to text, images, videos, comments, etc. (hereinafter referred to as "Posted Content") posted or transmitted by Users to this Service shall, in principle, belong to the Users or the rightful owners.
  2. Users grant the Company a non-exclusive, royalty-free license to use Posted Content to the extent necessary for the operation, improvement, and promotion of this Service (including display, distribution, analysis, and fraud prevention within this Service), including translation, summarization, and resizing.
  3. Users warrant that their Posted Content does not infringe the rights of third parties (including that necessary permissions have been obtained).
  4. If the Company reasonably determines that Posted Content violates these Terms or is inappropriate, the Company may delete or hide all or part of such Posted Content without prior notice to the User.
  5. When using the travel log sharing feature, Users who are shared with may be able to view and save (download, etc.) the Posted Content (including photos and videos). Users shall sufficiently confirm the scope of sharing and use the sharing feature at their own responsibility.

Chapter 8: Service Changes, Interruption, and Termination

Article 15 (Service Changes)

  1. The Company may change the content of this Service (feature additions/changes, display content, terms of provision, etc.) without prior notice to Users.
  2. The Company shall endeavor to notify Users in advance by reasonable means (in-app notification, website posting, etc.) when making significant changes.
  3. The Company may provide premium features or other paid services in the future. The terms for such services shall be separately determined by the Company and displayed within the App, etc.

Article 16 (Interruption and Suspension)

  1. The Company may interrupt or suspend all or part of this Service in any of the following cases:
    1. System maintenance, inspection, or updates (including mandatory updates)
    2. Failures in communication lines, cloud services, etc.
    3. Force majeure such as earthquakes, typhoons, heavy rain, floods, lightning, heavy snow, fires, power outages, infectious disease outbreaks, etc.
    4. When external data provision is suspended or delayed due to traffic disruptions, disaster response, etc.
    5. Other cases deemed unavoidable by the Company
  2. The Company shall be liable for damages incurred by Users due to interruption or suspension under this Article to the extent specified in Article 19.

Chapter 9: Disclaimer

Article 17 (Accuracy of Information)

  1. The Company does not guarantee the accuracy, completeness, or timeliness of tourism information (business hours, closing days, prices, event information, transportation information, etc.), congestion information, reviews/posts, coupon information, etc. provided on this Service.
  2. Please be sure to check official websites, official announcements, and on-site guidance for facility operating conditions and event implementation status.
  3. Congestion Forecasts are reference information and results are not guaranteed (Article 4).

Article 18 (Accidents and Troubles)

  1. Users understand the risks associated with tourism, travel, and activities (accidents, injuries, theft, infectious diseases, heatstroke, natural disasters, transportation delays/cancellations, road regulations, facility closures/admission restrictions, etc.) and shall use this Service at their own responsibility.
  2. The Company shall, in principle, not be liable for damages incurred by Users due to any of the following reasons:
    1. Weather or disasters (earthquakes, typhoons, heavy rain, floods, landslides, volcanic eruptions, etc.) causing inability to travel, evacuation, facility closures, or danger
    2. Transportation troubles (delays, cancellations, congestion, accidents, traffic regulations, strikes, etc.) causing schedule changes, inability to reach destinations, or additional costs
    3. Troubles at tourist destinations, facilities, or stores (including partner businesses) (service content, quality, sanitation, accidents, refund handling, etc.)
    4. Troubles between Users or troubles caused by posts or actions of third parties
  3. Information such as "disaster/congestion status" displayed on this Service is reference information based on partner municipalities, external data, estimates, etc., and is not official information such as evacuation information or traffic information. In emergencies or when danger is anticipated, Users must check official/public information from the Japan Meteorological Agency, local governments (evacuation orders, etc.), police, fire departments, transportation agencies, etc., and follow their instructions.
  4. The Company shall not be liable for accidents, etc. caused by Users operating the App while walking, riding a bicycle, or driving a vehicle. Users shall observe traffic rules in each country and region and operate the App in a safe location.

Chapter 10: Limitation of Liability

Article 19 (Scope of Liability)

  1. Even if the Company is liable to compensate Users for damages, except in cases of intentional or gross negligence by the Company, the Company's liability shall be limited to direct and ordinary damages actually incurred by Users.
  2. The Company shall not be liable for special damages, indirect damages, lost profits, data loss, lost opportunities, etc., except in cases of intentional or gross negligence by the Company.
  3. If there is a paid portion of this Service, the Company may separately set an upper limit for compensation (e.g., recent usage fees) when the Company is liable for damages.
  4. The provisions of this Article may be invalidated in whole or in part by the Consumer Contract Act or other applicable laws. In such cases, the provisions of the applicable laws shall apply to the extent of invalidity.

Chapter 11: Suspension of Use and Account Deletion

Article 20 (Suspension of Use)

  1. The Company may suspend the use of this Service by a User or restrict the User's account without prior notice if the Company reasonably determines that the User falls under any of the following:
    1. Violation of these Terms
    2. Fraudulent activities, impersonation, or security concerns
    3. False registration information
    4. Suspected affiliation with antisocial forces
    5. Other cases where operational necessity exists
  2. The Company shall not be liable for damages incurred by Users due to measures under this Article, except in cases of intentional or gross negligence by the Company.

Article 21 (Withdrawal and Data Handling)

  1. Users may withdraw (delete their account) at any time through methods specified by the Company (e.g., the withdrawal/account deletion feature within the App).
  2. Data handling after withdrawal shall, in principle, be as follows:
    1. The Company shall delete data associated with withdrawn Users by the Company's prescribed method. Deleted data may not be recoverable.
    2. However, records (logs, etc.) may be retained for a certain period to the extent necessary for legal compliance, security, fraud prevention, dispute resolution, etc.
  3. The display and handling of travel logs that were shared may vary depending on the specifications and operation of this Service. Please refer to in-app guidance or the Privacy Policy for details.

Chapter 12: Amendment of Terms

Article 22 (Amendment of Terms)

  1. The Company may amend these Terms in the following cases:
    1. When the amendment is compatible with the general interests of Users
    2. When the amendment does not contradict the purpose of these Terms and is reasonable in light of the necessity of the amendment, the appropriateness of the content, and the method of notification of the amended content
  2. When amending these Terms, the Company shall notify Users of the amendment content and effective date by reasonable means such as in-app notification or posting on the Company's website.
  3. For significant amendments (such as important changes to the handling of collected information or third-party provision), the Company shall endeavor to provide prior notice in an easy-to-understand manner.

Chapter 13: Miscellaneous

Article 23 (Notification Method)

  1. Notifications from the Company to Users shall be made by in-app notification, push notification, posting on the Company's website, sending to the registered email address, or other methods deemed appropriate by the Company.
  2. Users shall maintain device settings and registration information appropriately so that they can receive notifications.

Article 24 (Exclusion of Antisocial Forces)

  1. Users represent and warrant that they do not currently and will not in the future fall under the category of antisocial forces such as organized crime groups, members of organized crime groups, companies related to organized crime groups, corporate extortionists, etc., and that they are not involved in providing funds or otherwise with such forces.
  2. The Company may suspend the use of this Service, delete the account, or take other measures without prior notice if a User violates the preceding paragraph.

Article 25 (Prohibition of Assignment of Rights and Obligations)

Users shall not assign, transfer, pledge, or otherwise dispose of their status or rights and obligations under these Terms to third parties without the prior written consent of the Company.

Article 26 (Severability)

Even if any provision or part of these Terms is determined to be invalid or unenforceable by applicable laws, the remaining provisions shall continue to be valid.

Article 27 (Language)

  1. The official text of these Terms shall be in Japanese.
  2. The Company may provide translations of these Terms (English, Traditional Chinese, Simplified Chinese, Korean, etc.) for the convenience of Users, but such translations are for reference purposes only. In the event of any discrepancy between the Japanese version and a translation, the Japanese version shall prevail.

Chapter 14: Governing Law and Jurisdiction

Article 28 (Governing Law and Jurisdiction)

  1. These Terms and this Service shall be governed by the laws of Japan.
  2. Any disputes arising between the Company and Users in connection with these Terms or this Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance (unless otherwise permitted by applicable laws).

Supplementary Provisions

These Terms shall be effective from January 8, 2026.
